As of September of 2024, the legality of 504 plans, which guarantees students with certain disabilities are ensured that their learning needs are met, has been questioned. The root of this lawsuit occurred when the Biden Administration included “gender dysmorphia,” under the definition of disability which would protect transgender children from discrimination through the federal-rulemaking process. Now 17 states, including Indiana, are suing the federal government to have 504 accommodations removed from schools. This ban would affect 15% of students in public schools who fall under 504 plans.
On February 28th, there was a protest held outside the Bloomington courthouse in support of protecting student’s rights to have 504 plans.
